Abstract:
Mecelle can be accepted as the first example of the canonization process of Islamic jurisprudence in the area of civil law. It also has been a source of inspiration in the formation civil law altogether. It is not only popular and used in Turkey but most of the Islamic world such a Tunusia, Irak, Israil Morocco and some others places. So many commentaries which written were on it can show us the importance of Mecelle by itself Ali Haydar Efendi's "Dürerü'l-Hükkâm Şerh-i Mecelleti'l-Ahkâm", which was studied by us, is considered as one of the important commentary on it. Our work consist of the sources determination and verificatio (941-949, 957-1007.) items that is relevant with the magic part of "Dürerü'l-Hükkâm" of his work. Before making the sources determination and verification, we latinize the text in order to make it easier those interested to benefit from the text. In doing so, we make an effort as much as possible to be loyal to the original text. VII We have given information about Ali Haydar Efendi 's Works in the introduction of our thesis. And we have made latinization and verification work of (941-949, 957- 1007.) items in the main section as well. The aim of our study is to make it understandable for the student of Islamic jurisprudence and the reader study who interest which Islamic law to benefit from this book by making latinization and verification work of the section that we said previously.
