Özet

Klasik İslâm ilim geleneğinde mukaddimeler, sadece önsöz mahiyetinde değil, müellifin ilmî yönelimini, yöntemini ve metnin yapısal çerçevesini ortaya koyan kurucu metinler olarak kabul edilmiştir. Özellikle sistematik düşünce gerektiren fıkıh gibi alanlarda, mukaddimeler hem ilmî meşruiyetin zeminini hem de metodolojik yönelimi ifade eden temel metinlerdir. Buna rağmen, modern İslâm hukuku literatüründe mukaddimeler çoğu zaman ikincil veya biçimsel unsurlar olarak değerlendirilmiş, bu da konunun yeterince ele alınmamasına yol açmıştır. Bu çalışma, söz konusu eksiklikten hareketle, mukaddime kavramını, tarihî gelişimini, yapısal ve işlevsel yönlerini inceledikten sonra, Hanefî fıkhının temel kaynaklarından el-Hidâye’ye yazılmış bazı matbu şerhlerin mukaddimelerini incelemektedir. Seçilen metinler içerik, yapı ve işlev açısından değerlendirilmiş, müelliflerin ilmî tavırları, şerh gerekçeleri, isnad anlayışları ve metodolojik yaklaşımları mukaddimeler üzerinden tahlil edilmiştir. Bu araştırma, mukaddimelerde dile getirilen yöntem ve ilmî iddiaları incelenen eserin metni üzerinden örnekleyerek doğrulamayı değil; mukaddimeleri bağımsız ve kurucu metinler olarak ele alıp fıkıh yazım geleneğindeki işlevsel ve metodolojik konumlarını tespit etmeyi amaçlamaktadır. Mukaddimelerin, ilmî geleneği taşıyan ve yeniden üreten metinler olduğu ortaya konmuş; bu bağlamda fıkıh yazımında mukaddimenin ilmî otoriteyi kurma, geleneği aktarma ve metodolojik yönlendirme gibi çok yönlü roller üstlendiği tespit edilmiştir. Araştırmanın sonucunda, fıkıh literatüründe mukaddimelerin daha fazla önemsenmesi gerektiği ve bu alanda yapılacak kapsamlı çalışmaların, İslâm hukukunun ilmî üretim ve metin inşa süreçlerinin daha iyi anlaşılmasına katkı sağlayacağı kanaatine varılmıştır. Çalışma, İslâm hukuk düşüncesinde metodolojik yaklaşımların ve şerh geleneğinin daha iyi kavranması için bu alanda yapılacak yeni ve kapsamlı araştırmalara duyulan ihtiyaca işaret etmektedir.
In the classical Islamic scholarly tradition, prefaces (muqaddimāt) have been regarded not merely as introductory texts, but as foundational writings that articulate the author’s scholarly orientation, methodological approach, and the structural framework of the work. Particularly in disciplines such as Islamic law (fiqh), which require systematic reasoning, prefaces function as essential texts that establish both scholarly legitimacy and methodological direction. Despite this significance, prefaces have often been treated as secondary or merely formal elements in modern Islamic legal scholarship, resulting in insufficient attention to their analytical value. Against this backdrop, the present study examines the concept of the muqaddima, its historical development, and its structural and functional characteristics, before analyzing the prefaces of selected printed commentaries (shurūḥ) written on al-Hidāya, one of the principal works of the Ḥanafī legal tradition. The selected texts are evaluated in terms of content, structure, and function, and the authors’ scholarly attitudes, motivations for commentary, conceptions of isnād, and methodological approaches are analyzed through their prefaces. This study does not aim to verify the methodological claims and scholarly assertions expressed in the prefaces by tracing them through the main text of the works; rather, it treats prefaces as independent and constitutive texts and seeks to identify their functional and methodological positions within the tradition of legal writing. The analysis demonstrates that prefaces serve as texts that transmit and reproduce the scholarly tradition; in this context, it is shown that prefaces in fiqh literature assume multifaceted roles, such as establishing scholarly authority, transmitting tradition, and providing methodological guidance. The study concludes that greater attention should be given to prefaces in Islamic legal literature and that comprehensive future research in this area would contribute to a deeper understanding of the processes of scholarly production and textual construction in Islamic law. Accordingly, the study highlights the need for further extensive research to enhance our understanding of methodological approaches and the commentary tradition within Islamic legal thought.
